1. Scope

These Terms of Service (hereinafter referred to as "Terms") define the conditions of use for the KaruteCo app (hereinafter referred to as "the Application"). Users are deemed to have agreed to these Terms by using the Application.

The Application grants only the non-exclusive, non-transferable personal use right to users. Users are prohibited from the following acts.

Users must not engage in the following acts. If these are violated, the Operator reserves the right to suspend or delete the user account.

6. Limitation of Liability and Disclaimer

The Application is provided "AS IS." The Operator makes no warranties regarding the Application's proper operation, compatibility, accuracy, or reliability.

Except when the Operator has intent or gross negligence, the Operator assumes no liability for damages (direct damages, lost profits, opportunity loss, data loss, etc.) suffered by users using the Application.

The upper limit of the Operator's liability for damages is equivalent to the usage fees paid by the user for the Application within the last 3 months. However, if the applicable amount is less than 1,000 yen, it shall be 1,000 yen.

Furthermore, the Operator assumes no liability for damages caused by device failure, communication line failure, OS bugs, or reasons outside the Operator's responsibility.

For handling of personal information in the Application, please refer to the Privacy Policy separately. This forms part of these Terms.

9. Signature and Consent Features

The Application provides features for patients to sign consent forms. Signature data is stored in a local database on the device. Unauthorized access or alteration of the signature canvas is prohibited.

Through the consent version management feature, past consent content can be saved and referenced. If consent content is updated, version upgrade may be performed, and the latest version will apply to new patients.

10. PIN Code Authentication

The Application's admin features are protected by PIN code. Please manage the PIN code appropriately and do not disclose it to third parties. The Operator is not responsible for handling forgotten PIN codes.

11. Data Backup

The Application provides a feature to export all customer data in JSON format from the admin screen. Exported data should be managed appropriately by the user themselves. The Operator assumes no liability for loss of backup data.

12. Data Storage

Important Notice: Patient information, consent data, and app settings are stored only in a local database on the user's device. This data is not stored in the cloud or on external servers. Therefore, if the device is replaced or reset, data cannot be restored. Please use the backup feature as necessary.

13. Google Services (Planned)

The Application plans to implement the following Google services for usage analytics and ad delivery.

14. Governing Law and Jurisdiction

These Terms are interpreted and applied in accordance with Japanese law. For all disputes arising in connection with the Application, the Chiba District Court shall be the exclusive agreed jurisdiction court of first instance.

Note that as the Operator provides services to users worldwide, international laws (GDPR, CCPA, etc.) may be considered as necessary.

15. Changes to Terms

The Operator may change these Terms without prior notice. Changed Terms become effective from the time they are posted in the Application or on the website. If users do not agree to the changed Terms, they may stop using the Application and uninstall it.

16. Consent

Users are deemed to have agreed to all provisions of these Terms at the time of downloading or using the Application. Continued use when these Terms are changed also implies consent to the changed content.
